1.Introduction and acceptance

1.1 These Terms and Conditions (“Terms”) apply to all visitors, users, and others who access or use the website with domain name frontflyer.com (“Website”) or subscribe to services from POSITIVEREADS LLC (“Company”). The terms “You” and “Your” refer to anyone who accesses or uses this Website or subscribes to our services.

1.2 FrontFlyer serves customers in the United States. You must be located in the United States to subscribe.

1.3 These Terms outline:

  • Rules for using the Website and services
  • Permissible use of Website and service content
  • How the Company may use content you share
  • Rights and responsibilities of both parties
  • License terms for service access
  • Payment and refund policies
  • How disputes are resolved, including binding individual arbitration and a class action waiver (section 20), which you may opt out of

1.4 By creating an account or subscribing to our services, including by tapping a subscribe or upgrade button next to a link to these Terms, you accept and agree to be bound by these Terms, including our Privacy Policy, which is incorporated by reference.

2.Description of service

2.1 FrontFlyer publishes reviewed flight-fare information and offers an optional paid alert subscription, including:

  • A public feed of verified flight deals, with Business Class shown first, free to browse without an account
  • Paid email alerts matched to supported US home airports, trip types, domestic opt-in, and optional dream destinations
  • Fare details reviewed before publication, including the route, travel dates, observed price, and booking link
  • Provider-labelled links to Google Flights or Skyscanner, with an airline-direct status only when that path was verified

2.2 The Essential plan covers Economy and Business Class deals. Alert volume and timing depend on qualifying fares, verification, and editorial approval. We do not guarantee a minimum number or delivery cadence.

3.Deals are information, not offers

3.1 FrontFlyer is not a travel agency or seller of travel. We do not sell, book, reserve, or arrange air transportation, we do not take payment for any ticket, we receive no commission from airlines or travel agencies, and we are not a party to any booking. Approved fare cards may link out to a third-party airline or travel agency, and the price, seat availability, baggage rules, and booking terms are theirs alone.

3.2 Fares change constantly and can be corrected, sold out, or cancelled by the provider, sometimes after you have paid. We cannot guarantee that any specific price will still be bookable when you click through or that a provider will honor a changed fare.

3.3 You are responsible for checking the final price, the exact dates, the airports, the baggage allowance, and the fare conditions on the third party's site before you pay, and for any visa, passport, or entry requirement of your trip.

4.License to use services

4.1 When you subscribe to our services, you are granted a license to use the Service under the following terms:

  • Non-exclusive: The Company may grant this same license to others
  • Non-transferable: You cannot transfer your license to another person
  • Non-sublicensable: You cannot grant sublicenses to others
  • Limited: Only the rights specifically stated in these Terms are granted to you
  • Revocable: The Company reserves the right to revoke your license for violations of these Terms

4.2 Your license permits you to:

  • Access and use the Service for your personal travel planning
  • Receive alerts and browse the deals matched to your preferences
  • Book, on third-party sites, the fares we surface

4.3 Your license does NOT permit you to:

  • Share login credentials with others
  • Grant access to the Service to anyone else
  • Scrape, copy, republish, resell, or redistribute our deals, alerts, or price data, in whole or in part
  • Use the Service, or data obtained from it, to build or feed a competing product
  • Create derivative works based on the Service
  • Disassemble, decompile, or attempt to extract source code
  • Circumvent technical restrictions or exceed usage limits

5.Registration and user account

5.1 To use the paid Service, you must:

  • Be at least 18 years old
  • Have legal capacity to enter into contracts
  • Provide accurate and current information during registration

5.2 You are responsible for maintaining the confidentiality of your login credentials. Any use of your account is presumed to be by you. In case of unauthorized access, you must notify us immediately at support@frontflyer.com.

5.3 The public deal feed can be browsed without an account. Personalized alerts require an account and an active subscription.

6.Content ownership

6.1 Your content: You retain ownership of the information you provide, including your travel preferences and saved deals.

6.2 Our Service: We retain all rights to the Service, the software, the deal database, the ranking and scoring logic, and our proprietary technologies. Fare data compiled and presented by FrontFlyer may not be extracted or reused.

6.3 You grant the Company a non-exclusive, royalty-free license to use the information you provide only to operate, provide, and improve the Service for you. We will not publish a testimonial or review from you without your separate permission.

7.Third-party services

7.1 Booking happens on third-party sites (airlines and online travel agencies). Their terms and privacy policies apply to that booking, and we are not responsible for their services, their pricing, or their customer support.

7.2 If you sign in with Google, you authorize us to receive the basic profile information needed to create and identify your account.

7.3 Payments are handled by Stripe. Your card details are provided directly to Stripe and are never stored by us.

8.Plans, pricing, and subscriptions

8.1 Plans:

  • The public deal feed is free and requires no account
  • FrontFlyer Essential costs $49 USD per year and includes email alerts for verified Economy and Business Class deals matched to your selected supported US home airports and trip preferences
  • FrontFlyer Platinum Concierge is an optional, separately billed service at $199 USD per year or $59 USD every three months. It provides personal flight research, recommendations, and booking guidance. It is information and advice only: we do not book, hold, or pay for any ticket, you buy any ticket from the provider yourself, and it does not include hotels or text-message alerts
  • A subscription purchased under an earlier plan keeps the plan, price, and renewal terms shown when it was purchased
  • The price and renewal terms shown at checkout are the terms you authorize when purchasing
  • The checkout page shows the complete amount we will charge before you authorize payment

8.2 Subscription billing:

  • Subscriptions are billed in advance for each billing period: yearly for yearly plans, and every three months for the quarterly concierge plan. Each subscription renews and can be canceled independently
  • By subscribing, you authorize recurring charges to your payment method through our payment processor, Stripe
  • Your subscription auto-renews each billing period at the renewal price disclosed to you, until you cancel
  • Before each renewal we email you a reminder with the price, the renewal date, and how to cancel: 30 days before a yearly renewal, and 7 days before a quarterly one
  • Missed or failed payments may result in restricted or suspended access until payment is made, and do not release you from the obligation to pay

8.3 You may cancel online at any time from your account, which opens the Stripe billing portal, or by emailing support@frontflyer.com. Cancellation prevents the next renewal and does not end access before the current paid period expires.

8.4 The Company may change the price or the content of a plan. We will email you notice of a price change, with how to cancel, 7 to 30 days before it takes effect. A price change applies only from your next renewal, so you can cancel beforehand if you do not accept it.

8.5 Chargebacks: if you dispute a charge with your bank instead of contacting us, we may suspend or terminate your account. Access to a disputed subscription is suspended while the dispute is open, resumes if it is resolved in our favor, and ends if the payment is reversed. Please email us at support@frontflyer.com first.

9.Refunds and cancellation

9.1 60-day money-back guarantee: if you are not satisfied with FrontFlyer Essential, email support@frontflyer.com within 60 days of the date you first joined and we refund your first Essential payment in full, with no questions asked. The refund goes back to the original payment method, and access ends as section 9.2 describes. The guarantee applies once per person and covers the first payment only.

9.1.1 Other payments: renewal payments, and payments for any other subscription, are final and non-refundable, except where a refund is required by law or for a confirmed billing error. We do not provide prorated refunds or credits for unused time after cancellation.

9.2 Where a full refund of a subscription payment is made, that subscription and its access end when the refund is made, and it does not renew.

9.3 You may cancel at any time through the billing portal to prevent a future renewal. Cancellation takes effect at the end of the current paid period, and you keep paid access until that date. Each subscription renews and is cancelled separately, and ending one does not end another.

9.4 This policy does not limit any refund or consumer right that cannot be waived under the law applicable to you. For example, if you were charged after you asked us to cancel, or were charged a changed price without the notice these Terms promise, we refund that charge.

9.5 If you see a duplicate charge or other billing error, contact support@frontflyer.com so we can investigate and correct it.

9.6 We can only refund an eligible FrontFlyer subscription payment. We cannot refund flights, hotels, or anything else you booked with a third party, including a fare that was cancelled or repriced.

10.Subscription duration and termination

10.1 The subscription is entered into for the billing period selected.

10.2 Termination by user: You may terminate your subscription at any time as section 8.3 describes. Termination takes effect at the end of the current billing period.

10.3 Termination by Company: We reserve the right to suspend or terminate your account in case of:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment
  • Scraping or redistribution of our deals

10.4 Consequences of termination:

  • Your access to the paid Service ends when termination takes effect
  • Your personal data is handled according to our Privacy Policy
  • Terms that by their nature should survive termination remain in effect

11.Acceptable use

11.1 You may use the Website and services only for lawful purposes. You agree not to:

  • Use or distribute any malicious software or harmful material
  • Attempt to hack or gain unauthorized access to any part of the Website
  • Automate, scrape, or bulk-download the deals feed, the alerts, or the price data
  • Send unauthorized material or disrupt the Website's operation
  • Engage in any activity that would harm the Company's reputation
  • Distribute spam or harmful content

11.2 You are responsible for damages resulting from your violation of these Terms, to the extent the law allows.

12.No guarantee of results

12.1 The number, quality, and destinations of the deals you receive depend on your home airports, your preferences, the season, and the market. We do not guarantee a minimum number of alerts, a minimum discount, a specific destination, or that a deal will appear for your exact dates.

12.2 Prices shown are the prices we observed at the time of the check. They are indicative and may already have changed when you see them.

13.Disclaimers and no warranties

13.1 To the extent permitted by law, the Service is provided “as is” and “as available”, and the Company disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2 Content on the Website is provided for informational purposes only and is not a substitute for professional travel, legal, or financial advice.

14.Limitation of liability

14.1 Your use of the Website and services is at your own risk. You are solely responsible for the bookings you make and for verifying a fare before paying for it.

14.2 The Company is not liable for damages resulting from:

  • Your use or misuse of the Service
  • A fare that changed, sold out, was corrected, or was cancelled by the airline
  • Bookings, refunds, or disputes with a third-party seller
  • Missed alerts, delayed alerts, or errors in the data
  • Errors, delays, or website interruptions
  • Loss of income, revenue, profits, or business

14.3 To the extent permitted by law, the Company shall not be liable for any indirect, consequential, incidental, special, or exemplary damages.

14.4 To the extent permitted by law, our total liability for any claim relating to the Service shall not exceed the amounts paid by you during the twelve (12) months preceding the claim.

14.5 Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so some of these limits may not apply to you.

15.Indemnification

15.1 To the extent permitted by law, you agree to indemnify and hold the Company harmless from third-party claims, and the resulting damages, costs, and reasonable attorney's fees, arising from:

  • Your violation of laws or regulations
  • Your violation of these Terms
  • Your infringement of intellectual property or other rights

15.2 The Company will notify you of any such claim, and you will reasonably cooperate in its defense.

16.Intellectual property

16.1 All content on the Website including text, images, graphics, software, deal data, and other materials is the property of the Company and is protected by intellectual property laws.

16.2 You agree not to:

  • Copy, reproduce, or distribute any proprietary content
  • Modify, create derivative works, or reverse engineer the Service
  • Remove any copyright or proprietary notices from content

16.3 If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use and incorporate them into the Service.

17.Privacy and data protection

17.1 Our Privacy Policy explains how we collect, use, and protect your personal information.

17.2 You agree to receive the deal alerts you subscribed to, plus emails related to your account, your subscription, and service updates. You can unsubscribe from alerts at any time. Marketing email is sent only if you opt in.

18.Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain valid and enforceable. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent.

19.Amendments

19.1 The Company may update these Terms. The date at the top of this page shows when they last changed.

19.2 We will email you notice of a material change at least 14 days before it takes effect. For a paid subscription, a material change applies from your next renewal, and you may cancel before then if you do not accept it. Price changes follow section 8.4.

19.3 A change to section 20 never applies to a dispute that arose, or of which we had notice, before the change.

20.Dispute resolution and arbitration

20.1 Talk to us first. Before starting any claim, you and the Company agree to try to resolve the dispute informally. Send a written description of the dispute and the relief you want to support@frontflyer.com; we will send ours to your account email. If the dispute is not resolved within 30 days, either party may start a proceeding as this section allows.

20.2 Binding individual arbitration. Any dispute relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator, and not in court. The arbitration may be held by video or in the county where you live. The Federal Arbitration Act governs this section. Your arbitration fees are limited to what the AAA Consumer Arbitration Rules require of consumers, and the Company pays the rest.

20.3 Small claims. Either party may instead bring an individual claim in small claims court.

20.4 No class actions. You and the Company may bring claims against each other only individually, and not as a plaintiff or class member in any class, collective, or representative proceeding. If this class action waiver is found unenforceable for a claim, that claim is not subject to arbitration and proceeds in court under section 21.

20.5 Opting out. You may opt out of this section 20 by emailing support@frontflyer.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these Terms.

21.Governing law and venue

These Terms are governed by the laws of New Mexico, United States, without regard to its conflict of law rules, and by the Federal Arbitration Act for section 20. Any dispute not subject to arbitration shall be resolved in the state or federal courts of New Mexico, United States, unless the law of the state where you live gives you the right to bring it there. This does not remove any consumer protection that the law of your state of residence grants you and that cannot be waived.
